Waiver of Liability, Hold Harmless Agreement and Photo Release
All Participants will be required to accept the terms and conditions of this waiver of Liability for any and all Ways2Escape Tours, Escapes, Events hosted and sponsored by Ways2Escape.
CONSENT, WAIVER OF LIABILITY, RELEASE, COVENANT NOT TO SUE AND INDEMNIFICATION AGREEMENT (“AGREEMENT”)
PLEASE READ THIS AGREEMENT CAREFULLY BEFORE SIGNING: THIS AGREEMENT OPERATES TO WAIVE ALL CLAIMS FOR PERSONAL INJURY AND TO IMPOSE LEGAL OBLIGATIONS ON YOU RELATING TO AND ARISING FROM YOUR PARTICIPATION IN ANY AND ALL WAYS2ESCAPE ESCAPES, HOSTED AND SPONSORED BY WAYS2ESCAPE.
I, the undersigned, agree to this release of all claims, waiver of liability and assumption of risk (“Waiver and Release”). I waive any and all claims I may have now and in the future, and forever and unconditionally release from all liability and agree not to sue Ways2Escape, its officers, owners, managers, partners, contractors, insurers, shareholders, directors, members, affiliated entities, parent companies, subsidiaries, agents, representatives, present and former employees or tour guides [hereafter referred to as “Staff”] for any personal injury, death, property damage, or loss sustained by me as a result of my participation in a tour, escape, or event offered by Ways2Escape, due to any cause whatsoever, including without limitation, negligence on the part of Ways2Escape, its Staff, tour partners, or other participants, or death or injury as a result of war, civil unrest or epidemic. I further agree that if I violate this agreement and attempt to bring suit against any part of parties named herein, that I will be held responsible for attorney’s fees and any costs incurred by that person in defending such action.
I am aware that the tours, escapes, and events offered, in addition to the usual dangers and risks inherent, has certain additional dangers and risks, some of which include: physical exertion for which I may not be prepared and weather extremes subject to sudden and unexpected change. I accept all the inherent risks of the proposed tour, escape, or event and the possibility of personal injury, death or property damage or loss resulting there from. I acknowledge that the enjoyment and excitement of the proposed form of tour, escape, or event is derived in part from the inherent risks incurred by travel and activity beyond the accepted safety of life at home or work, and these inherent risks contribute to such enjoyment and excitement, being a reason for my participation. I agree that if I suffer injury or illness Ways2Escape, or its Staff can, at my cost, arrange any medical treatment and emergency evacuation service as it or they deem necessary for my health and safety. Further, I agree at all times during this tour, escape, or event, to abide by and comply with any additional instructions given by my tour guide or any other Staff and I accept that non-compliance may result in injury, death or permanent disability. I understand that non-compliance may result in my removal from the tour, escape, or event.
In entering this Waiver and Release, I am not relying on any oral, written nor visual representations or statements by Ways2Escape, or its Staff or any other inducement or coercion to go on this tour, escape, or event. I understand and confirm that my participation in this tour, escape, or event is voluntary. I am in good health and suffer from no physical or mental condition that would make me especially susceptible to injury or disability while participating in this tour, escape, or event. I confirm that, by my own free will, I have read and understood the Terms and Conditions of this tour, escape, or event and Wavier and Release and agree that this Waiver and Release will be binding upon my heirs, beneficiaries, next of kin, executors, administrators and successors.
I hereby grant to Ways2Escape, the unrestricted right and permission to copyright and use photographic portraits, pictures, video footage and/or audio recordings of my participation in this tour, escape, or event in which I may be included intact or in part, including the negatives, prints, transparencies or digital information relevant to such portraits (the “Material”). Ways2Escape, has the right to reproduce, exhibit, distribute, broadcast, digitize, edit, or otherwise use the Material, by any method and in any media, whether now existing or later created, without restriction throughout the world, by incorporating the Material into its website, publications, catalogues, brochures, books, magazines, or commercial, informational, educational, advertising, or promotional materials relating thereto (collectively, the “Works’). I agree that Ways2Escape, is and shall be the exclusive owner of all right, title, and interest, including copyright, in the Material and the Works. I further grant Ways2Escape an irrevocable, royalty-free, worldwide license to use my name, and hometown in connection with the Material and the Works.
As a participant on this tour, escape, or event, I accept full responsibility for my behavior, well-being, and health throughout the tour, and accept all of the risks associated with my participation in this tour, escape, or event including, without limitation, injury or death resulting from exposure to unfavorable weather conditions, food sickness, allergic reactions, choking, and injuries arising from self-inflicted accidents or mishaps, other participants, transportation drivers, motor vehicles, and pedestrians. I understand that this tour, escape, or event takes place in public venues under conditions largely beyond Ways2Escape's control.
As a participant on this tour, escape, or event, I accept full responsibility for my behavior, well-being, and health throughout the tour, which may involve a variety of activities, unfamiliar locations, and modes of travel, including but not limited to: walking for a longer period than I am used to, and trying new escapes that are new to me. I further realize that this tour, escape, or event may involve walking through unfamiliar, narrow, unpaved and/or steep paths, gangways, roads, stairways and driveways. I knowingly and willfully accept these risks and take complete and total responsibility for my behavior, well-being and health during this tour, escape, or event. I agree to hold neither Ways2Escape, nor its Staff, or facility liable in any way should any harm come to me.
I assume all risks, known and unknown, foreseeable and unforeseeable, in any way connected with my participation in this tour, escape, or event. I accept personal responsibility for any liability, injury, loss, or damage in any way connected with my participation in this tour, escape, or event.
By purchasing this Tour, Escape, or Event, I affirm that I have fully understood this entire document and agree to these Terms and Conditions, Waiver and Release of Liability. I am indicating my voluntary agreement to the provisions of these Terms and Conditions and waiver and release of liability. Participation in the tour by a person who is not yet 18 years old indicates that a parent or legal guardian has also read and consented to this waiver.
